Unlawful Eviction

Members of Chambers can assist with the legal action required to address and rectify an unlawful eviction from residential property. Section 5 of the Housing Act 1988 provides that an assured tenancy cannot be terminated by the landlord unless it is done by order of the court and through the pursuit of a warrant of possession. Should a landlord fail to adhere to the formal procedure for evicting a tenant, he can be held liable for unlawful eviction. Furthermore, Section 1 of the Protection from Eviction Act 1977 makes it a criminal act to unlawfully or illegally evict a tenant.
